Terms of Service
Version 1.0 — Effective May 23, 2026
By installing, opening, or using Eatrica, you agree to these Terms. If you do not agree, please do not use the App. Section 5 (Important Disclaimers — AI, Food Safety, and Allergies) and Section 6 (Limitation of Liability) materially affect your legal rights — please read them carefully.
1. Description of Service
Eatrica is a camera-first recipe discovery app. You take a photo of your fridge or pantry using the in-app camera, an AI vision model identifies food ingredients in the image, you review and edit that ingredient list, and a separate AI model then generates three recipe suggestions tailored to your stated preferences. Eatrica Plus subscribers, where offered, may gain access to additional features such as expanded scan limits and enhanced personalization.
Eatrica is a culinary discovery and inspiration tool, nothing more. We do not sell food, groceries, grocery delivery, kitchen equipment, or any physical goods. We do not provide nutritional, medical, allergological, or dietary advice. The App is designed for casual, personal home cooking.
2. Account Registration and Security
You can begin using Eatrica anonymously without creating an account. To save your preferences and scan history across devices, you can upgrade to a full account by providing your name, a valid email address, and a password. You agree to:
- Provide accurate and complete registration information
- Keep your password confidential and not share it with anyone
- Notify us promptly if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 16 years of age to use the App.
3. Subscriptions and Payments
Eatrica offers a free tier with basic scanning and recipe recommendations, and a premium tier (Eatrica Plus) with additional features such as expanded scan limits and personalized recipe ranking.
By subscribing to Eatrica Plus, you acknowledge and agree to the following:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription at any time through Settings > Apple ID > Subscriptions on your device
- Free trials, when offered, provide temporary access to premium features. If you purchase a subscription before the trial ends, the unused portion of the trial will be forfeited
- Refunds are handled by Apple in accordance with Apple's refund policies
All transactions are processed by Apple through its In-App Purchase system. This App is licensed to you under Apple's standard Licensed Application End User License Agreement (EULA), except where these Terms provide additional terms.
4. User Responsibilities and Photo Content
When using Eatrica, you agree to:
- Use the App only for lawful, personal, non-commercial recipe discovery purposes
- Only capture photos that you have the right to take. Do not photograph other people, their property, or their personal effects without their consent, and do not capture or submit unlawful, harmful, or offensive imagery
- Not attempt to reverse-engineer, decompile, disassemble, or otherwise extract the source code of the App or its backend services
- Not attempt to gain unauthorized access to our systems, other users' accounts, or our underlying AI providers
- Not use automated scripts, bots, scrapers, or similar tools to interact with the App or its APIs
- Not deliberately attempt to abuse, overload, manipulate, or jailbreak the AI models that power the App (for example, by submitting prompts or images intended to elicit content unrelated to cooking)
You are solely responsible for the photos you capture and submit, the ingredient edits you make, and the cooking preferences you enter. Submitting inaccurate dietary or allergen information is your responsibility and may cause the App to suggest recipes that are not safe for you.
5. Important Disclaimers — AI, Food Safety, and Allergies
Please read this section carefully. It is the most important part of these Terms.
Eatrica is NOT a nutritionist, dietitian, doctor, allergist, food safety inspector, or licensed health professional of any kind. The App produces recipe suggestions using third-party artificial intelligence models (currently OpenAI's GPT-4o family). These models are probabilistic systems that can and do make mistakes.
Ingredient detection limitations. The AI vision model that identifies food in your photos can:
- Misidentify one ingredient as another (for example, calling a lemon a lime, or a chicken thigh a chicken breast)
- Miss ingredients that are present in the photo
- Hallucinate ingredients that are not actually present
- Fail to identify the freshness, condition, or food safety of any ingredient — the App cannot tell you whether food is spoiled, expired, or contaminated
Recipe generation limitations. The AI that generates recipes can:
- Produce recipes with incorrect cooking times, temperatures, or techniques — including undercooked meat, poultry, fish, eggs, or rice
- Suggest ingredient combinations or preparation methods that are unsafe for certain populations (pregnant people, immunocompromised people, young children, people with specific medical conditions)
- Fail to honour your dietary restrictions or allergen filters in every case
- Include ingredients you are allergic to, even when you have specified that allergen in your profile
Your responsibilities as the cook. You are responsible for:
- Visually verifying every ingredient before you use it — do not trust the detected list alone
- Reading the full ingredient list of every recipe before you start cooking
- Independently confirming that every ingredient is safe for you and anyone you are cooking for, especially with respect to allergies, intolerances, dietary restrictions, religious requirements, pregnancy, and medical conditions
- Applying proper food safety practices: safe internal cooking temperatures for meat, poultry, eggs, and seafood; safe handling and storage; and avoiding cross-contamination
- Using your own judgment about whether food in your fridge is still fresh and safe to eat
Allergen filtering is best-effort, not medical-grade. If you have a severe or life-threatening food allergy, do not rely on Eatrica's allergen filters as the only safeguard between you and an allergen. The filters are implemented as instructions to an AI model and may fail. Always read the full recipe and ingredient list before cooking.
Nothing in the App constitutes medical, nutritional, dietetic, allergological, or other professional health advice. For any medical or dietary decision, consult a qualified professional.
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including (without limitation) any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that recipes generated by the App will be safe, complete, accurate, suitable for any particular person, or free from error.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Eatrica and its operator shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App. This includes, without limitation, damages arising from or related to:
- Allergic reactions (including anaphylaxis), intolerances, or other adverse reactions to ingredients in recipes suggested or detected by the App
- Foodborne illness or food poisoning from food prepared based on recipes or ingredient detections produced by the App
- Burns, cuts, fires, or other cooking accidents
- Nutritional inadequacy or excess of any meal, diet plan, or food choice influenced by the App
- Use of ingredients that are spoiled, expired, contaminated, or otherwise unsafe
- Errors, inaccuracies, or hallucinations in AI-generated ingredient lists or recipes
- Loss of access to the App, your account, or your scan history
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims relating to the App shall not exceed the greater of (a) the total amount you have paid through the App in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).
If you are a consumer in a jurisdiction that does not permit the exclusion or limitation of certain warranties or liabilities (including the European Union), the limitations in this section apply only to the extent permitted by the law of that jurisdiction, and your mandatory statutory rights are unaffected.
7. Your Data and Account Deletion
You can permanently delete your account and all associated data from within the App at any time. When you delete your account:
- Your account is deactivated immediately
- All associated data (profile, preferences, scan history, session data) is permanently purged within 30 days
- This action cannot be undone — your data cannot be recovered
Deleting your account does not automatically cancel your subscription. You must cancel your subscription separately through your Apple ID settings before or after deleting your account.
Our collection and use of your personal information is governed by our Privacy Policy.
8. Intellectual Property and AI-Generated Content
The Eatrica app, including its name, branding, design, code, graphics, and copy, is owned by us or our licensors and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.
The recipes shown to you in the App are generated dynamically by a third-party AI model in response to your photo and preferences. Because AI-generated content has uncertain copyright status under many jurisdictions, we make no representation or warranty regarding the originality or copyright status of any individual recipe. We do not claim copyright over the AI-generated recipe text itself. You may cook from any recipe the App shows you for personal use; do not republish substantial bodies of recipe output as if it were your own original work.
The photos you capture and the preferences and edits you enter remain yours. We claim no ownership over your content, but by using the App you grant us a limited, worldwide, royalty-free licence to process that content as needed to provide the service — including sending photos and ingredient lists to our AI sub-processor for detection and recipe generation, as described in our Privacy Policy.
9. Termination
You may stop using Eatrica and delete your account at any time.
We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms.
10. Apple-Specific Terms
This section applies only when you obtain Eatrica through the Apple App Store. You acknowledge that:
- These Terms are between you and the operator of Eatrica, not between you and Apple. Apple is not responsible for the App or its content.
- Your licence to use the App is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by Apple's standard Licensed Application End User License Agreement (the "Apple EULA"). Where these Terms are stricter than the Apple EULA, these Terms apply.
- Apple has no obligation to provide maintenance or support for the App. Any maintenance or support questions should be directed to support@eatrica.app.
- To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App. Any claim that the App fails to conform to any applicable warranty may be directed to Apple, and Apple will refund the purchase price (if any). Beyond that, Apple has no other warranty obligations.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to comply with applicable law, or claims arising under consumer protection or similar legislation.
- If a third party claims that the App infringes that party's intellectual property rights, Apple is not responsible for the investigation, defence, settlement, or discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. If you are a consumer resident in the EU/EEA, you retain the protection of any mandatory provisions of the law of your country of residence. Any disputes arising out of or relating to these Terms or the App shall be submitted to the competent courts of Ukraine, without prejudice to your right as an EU consumer to bring proceedings in the courts of your country of residence.
12. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the version number and effective date and notify you through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, your sole remedy is to stop using the App and, if you wish, delete your account.
